Elder Game, LLC - Terms of Service Agreement
Version 2.0 - Updated February 17, 2026

1. Acceptance of Terms

PLEASE READ THESE TERMS CAREFULLY.

By doing any of the following:

  • Creating an account
  • Installing or launching the game client
  • Accessing the website
  • Purchasing or receiving digital items
  • Clicking ACCEPT
  • Using any Elder Game, LLC service

(collectively, the “Services”), including Project: Gorgon (the “Game”), you agree to be legally bound by these Terms as if you signed a written contract.

If you do not agree, you may not use the Services.

2. Eligibility

You must be at least 13 years old to use the Services.
If you are under the age of majority in your jurisdiction, a parent or legal guardian must agree to these Terms on your behalf and is responsible for your use of the Services.

You represent that you are legally capable of entering a binding agreement.

3. Account Registration & Security

You are responsible for all activity on your account.

You agree to:

  • Keep login credentials confidential
  • Not share accounts
  • Not transfer or sell accounts
  • Notify Elder Game immediately of unauthorized access

Elder Game may suspend or lock accounts suspected of compromise.

4. Digital Goods, Payments & Refunds

All purchases are purchases of:

  • Digital content
  • Service access
  • Virtual entitlements

They are not physical goods and have no real-world monetary value.

Unless required by law:

  • All sales are final
  • No refunds are provided
  • Virtual items may be modified or removed
  • Access may be revoked upon account termination

If purchased through a third-party platform (such as Steam), that platform’s refund policy governs the transaction.

Chargebacks or payment disputes may result in permanent account termination.

Purchasing accounts, currency, items, or services from unauthorized third parties is prohibited and may result in permanent account closure.

5. License Grant

Elder Game grants you a limited, revocable, non-exclusive, non-transferable, non-commercial license to:

  • Install the Game Client on devices you control
  • Access the Game for personal entertainment use

This license may be revoked at any time for violation of these Terms.

You may NOT:

  • Reverse engineer, decompile, or modify the client
  • Use bots, automation, macros, or data mining tools
  • Operate private servers or intercept communications
  • Exploit gameplay commercially (power-leveling, farming, resale services)
  • Circumvent technical protections
  • Use multiple accounts simultaneously to gain unfair advantage unless explicitly permitted

6. Ownership & Intellectual Property

All software, artwork, music, characters, text, gameplay systems, accounts, and related materials (“Content”) are owned by Elder Game, LLC or its licensors.

You receive a license only — no ownership rights.

You may not copy, distribute, or commercially exploit Content.

Elder Game may use:

  • Character names
  • Guild names
  • Screenshots
  • Gameplay footage

for promotional purposes without compensation.

7. User-Generated Content

By submitting chat, forum posts, screenshots, or other content (“UGC”), you grant Elder Game a perpetual, worldwide, royalty-free license to:

  • Host
  • Store
  • Modify
  • Display
  • Distribute
  • Use for promotion

Elder Game may remove content at its sole discretion.

8. Mods, Tools & Anti-Cheat

Allowed add-ons may be permitted at Elder Game’s discretion.

Prohibited software includes:

  • Bots
  • Packet interception tools
  • Memory editing tools
  • Automation software
  • Unauthorized overlays affecting gameplay

Use may result in immediate permanent ban without notice.

You consent to reasonable technical measures used to detect prohibited software.

9. Live Service Changes

The Game is a live service.

Elder Game may at any time:

  • Patch or rebalance gameplay
  • Modify characters or progression
  • Add or remove features
  • Reset data

No compensation is owed for these changes.

10. Service Availability

Services require internet connectivity and authentication servers.

Elder Game may suspend, discontinue, or modify any service at any time without liability.

11. Monitoring & Privacy

You consent to:

  • Logging of IP address and device identifiers
  • Monitoring of gameplay activity
  • Moderation of communications
  • Detection of unauthorized software

You have no expectation of privacy in public or in-game communications.

12. Code of Conduct

You must follow the Project: Gorgon Code of Conduct: https://projectgorgon.com/conduct.html

You may not:

  • Harass others
  • Exploit bugs
  • Impersonate staff
  • Disrupt the service
  • Evade moderation

Violations may result in warnings, suspensions, or permanent bans at Elder Game’s discretion.

13. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

Elder Game disclaims all warranties including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement

Service interruptions, bugs, or data loss may occur.

14. Limitation of Liability

To the maximum extent permitted by law:

Elder Game is not liable for indirect, incidental, consequential, or punitive damages.

Maximum liability shall not exceed the total amount you paid to Elder Game in the previous 12 months.

15. Indemnification

You agree to defend and indemnify Elder Game, LLC from claims arising from:

  • Violation of these Terms
  • Misuse of the Services
  • Activity on your account

16. DMCA / Copyright Complaints

To report copyright infringement, send notice to:

Include sufficient detail to identify the allegedly infringing material.

17. Dispute Resolution & Arbitration

Informal Resolution

Before filing a legal claim, contact:

We will attempt to resolve disputes within 30 days.

Binding Arbitration

If unresolved, disputes will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You waive the right to:

  • Jury trial
  • Class actions

Claims must be brought individually.

Small Claims Exception

Either party may bring claims in small claims court if eligible.

Governing Law & Venue

These Terms are governed by the laws of the State of Florida, USA.

Arbitration and any permitted court proceedings shall occur in Orange County, Florida, USA.

18. Termination

Elder Game may suspend or terminate accounts at any time for violation of these Terms.

Upon termination:

  • License ends immediately
  • Access to digital content is revoked
  • No refunds are owed

19. Changes to Terms

Elder Game may update these Terms at any time.

Continued use of the Services after changes constitutes acceptance.

20. Entire Agreement

These Terms, the Privacy Policy, and the Code of Conduct constitute the entire agreement between you and Elder Game, LLC.

If any provision is unenforceable, the remaining provisions remain valid.
